WHAT IS FORM EX107 USED FOR?

Form EX107 is the application form used to order a transcript of a court hearing. A transcript is a written document of what is said in the court hearing.

IS THERE A FEE TO SEND FORM EX107 TO THE COURT AND HOW TO PAY FOR IT?

Yes, there is a fee. Please refer to government guidance form 200 which lists the fees.

  • Please attach a cheque or postal order made payable to HM Courts & Tribunal Service.
  • If you are on certain benefits or on a low income, you can apply to the court to have your fee for form EX107 paid for you. The application form you need is called form EX105.

HOW TO COMPLETE FORM EX107 AND WHERE TO SEND IT.

  • NOTE 1 – You can complete form EX107 online then print a hardcopy. Alternatively you can download the form, print it and complete by black pen. 
  • NOTE  2- If you find there is not enough space to complete your answers on your form then please use additional sheets of paper to continue on and attach them to your form. Please write your name, address and question number on the top of your additional sheets of paper. 
  • NOTE  3 – Please keep a copy of your form EX107 and all attachments for yourself outside of the ones you send to the family court.
  • Form EX107 is 14 pages long.
  • Use a separate form EX107 for every transcript you need.
  • It is advisable to talk to the court where your hearing was held before you apply for a transcript/send your form EX107 into the court. Many courts have an authorised transcription company that they use and it is best to find out which one it is.  Occasionally the courts authorised transcription company may have already provided a stenographer or court logger to make a recording of the proceedings. In this case the courts authorised transcription company will provide the transcript. The court will inform you how to get this. 
  • Part A –
    • Part A1 will ask you to write your name in the box provided. 
    • Part A3 will ask you about your involvement in the case (are you a party to the case, legal representative, you have no involvement or other). Please tick the relevant box. 
    • Part A4 will ask if you have a reference.
    • Part A5 will ask you to write your address.
    • Part A7 will ask you for your phone number. 
    • Part A8 will ask for your email address. If you are unable to accept the transcript you are applying for by email you must tick the box. In this case the transcript will be posted to the address in part A5. 
    • Part A9 will ask you to tick the box of your preferred communication – email, phone or post.
    • Part A10 will ask you which transcription company have you chosen to do your work.
        • There are 5 different companies listed and all 5 companies provide transcripts for family hearings. You must tick the relevant box.
        • Please read part B8 below for private hearings. 
        • Please download EX107GN – guidance notes and read page 4 for prices in table B2. 
        • These 5 companies offer 2 types of service a) 48 hours and b) 12 working days.  
        • The contact details for these 5 transcription companies is on page 5 of EX107GN – guidance notes.
    • Part A11, A12, A13 and A14 will ask you if your transcript is being paid by public expense, the costs shared between both parties or paid for by a public funded certificate. A14 will ask about your payment details. Please complete accordingly. If you are on a low income or on certain benefits you can have your transcript paid by public expense. You will need to complete form EX 105 for this.

  • Part B –
    • Part B1 will ask you for the name of the court where the hearing took place
    • Part B2 will ask for the address of the court.
    • Part B3 will ask for the case name (Smith vs Smith).
    • Part B4 will ask you for the name of the judge who heard the case.
    • Part B5 will ask you to write down the details of barristers/solicitors representing the parties involved in the case.
    • Part B6 will ask you to write down your case number.
    • Part B7 is asking if there is a case reporting restriction and/or anonymisation imposed. Please complete accordingly.  
    • Part B8 will ask you if your case was heard in private (ex-parte), in the royal courts of justice or a crown court or another venue ordered by the court. Please complete accordingly.
        • For all private (ex-parte) hearings it is advisable to talk to the court where the private hearing was held before you apply for a transcript.
        • If your hearing was heard in private at the royal courts of justice/crown courts or at another venue authorisation will be required from the judge who presided over the private hearing. The transcript for private hearing is produced by the authorised transcription company for the sensitive case service – Opus 2. Due to the sensitive nature of the proceedings, transcription will take place at the secure transcription unit through an attendance based service.
        • In the county court, for civil cases all non parties to a private hearing must make an application to the court for permission to have the transcript. The form used is form N244.
        • In the family court, non parties to any family hearing must make an application to the court for permission to access the transcript They can do this by using form C2 for child arrangement cases and form D11 for financial settlement cases.

  • Part C –
    • Part C1 will ask you for the date and start and end times for the hearing.
    • Part C2 will ask you for the court or hearing room number.
    • Part C3 will ask you what type of transcript do you need. Please go to the Civil, Family and Tribunals part, you will be given a list and you will need to tick the one you need.
    • Part C4 will ask you if you need a new transcript or a copy of an existing transcript and if so how many do you need.
    • Part C5 will ask you which service level band do you require – within 48 hours or 12 days. Please tick accordingly. 
    • Part C6 will ask you once the transcription company you have chosen has your transcript do you require an estimate of cost before they produce the transcript.
    • Part C7 will ask if the original hearing was in Welsh and you need an English translation.
    • Part C8 will ask if the transcript is required urgently.
    • Part C9 will ask the reason for requesting the transcript. If the transcript is required for a future hearing you must give details of this hearing including the date and time. 
    • Part C10 will ask you if your hearing was a telephone hearing, skype, cloud video, fully video or other type of hearing. Please tick accordingly.
  • Part D will ask you to sign and date a declaration. 
  • Please leave part E. This court will complete part E.
  • Please send your completed form EX107 with any attachments to the court where you are sending your appeal form/where your appeal will be heard.
