Form used to apply to the family court for an arrest warrant when there has been
non compliance/breach of a female genital mutilation protection court order (FGMPO)

 

WHAT IS FORM FGM005 USED FOR?

Form FGM005 is the application form used to apply to the family court for an arrest warrant when there has been non compliance/breach of a female genital mutilation protection order (FGMPO).

Non compliance of a FGMPO can be dealt with in both the family and criminal court. If there is non compliance you have two options – 

  • You can contact the police. Breaching a FGMPO is a criminal offence and the police can arrest the person the FGMPO is against. This person is also known as the respondent. The court does not need to attach a power of arrest to the FGMPO nor does the person protected by the FGMPO or the person who applied for the FGMPO if they are different need to apply to the court for an arrest warrant. Breach of a FGMPO can result in a prison sentence for up to 5 years. 
  • Or if you DO NOT want to contact the police you can apply to the family court for an arrest warrant. The family court will deal with this as a contempt of court and can hand down a prison sentence for up to 2 years. You can also apply to the family court if the police and crown prosecution service decide not to take the breach of the FGMPO further. You can make an application to the court for an arrest using form FGM005. You must include a signed and dated statement of truth at the bottom of your statement such as ‘I believe the above statement to be truthful to the best of my knowledge’.

Please note the following – 

  • The respondent is the person the FGMPO is against.
  • The person to be protected is the person the FGMPO is protecting.
  • The applicant is the person who is completing the form(s) and submitting them to the court. This can be the person to be protected or another person.

WHAT IS THE FEE TO SEND FORM FGM005 TO THE COURT AND HOW TO PAY FOR IT?

At present there is no fee to send form FGM005 to the court.

HOW TO COMPLETE FORM FGM005 AND WHERE TO SEND IT.

  • NOTE 1 If you are completing and submitting form FGM005 you are known as the applicant. The other party whom the application is against is known as the respondent(s).
  • NOTE 2 You can complete form FGM005 online and then print a hard copy. Alternatively you can download it, print it and then complete by black pen. 
  • NOTE 3 If you find there is not enough space to complete your answers on your form FGM005 then please use additional sheets of paper to continue on and attach them to your form. Please write your name, address and question number on the top of your additional sheets of paper. 
  • NOTE 4 Please keep a copy of your form FGM005 and any attachments for yourself outside of the one you send to the family court. 
  • Form FGM005 is 2 pages long.
  • At the top of page 1 you will be asked to write the name of the court and the case number.
  • Underneath you will next be asked to write the full name of the applicant and the respondent(s) in the boxes provided.
  • Now you will be asked to write the date of the FGMPO in question and details of the FMPO that the respondent should have complied with.
  • In the next part underneath you must now write your full name as the applicant asking for the arrest warrant to be issued.
  • In the next box you will be asked to detail what in the original FGMPO the respondent(s) has breached/been non-compliant. 
  • On the top of page 2 you will be asked to sign and date a statement of truth.
  • As stated above please send your completed form FGM005 and all attachments to your local family court. Please click on the link below to find the address of your local family court.
