Application form to apply to the family court for an arrest warrant when there is a breach of a forced marriage protection order (FMPO)

 

WHAT IS FORM FL407A USED FOR?

Form FL407A is the application form used to apply to the family court for an arrest warrant when there has been non compliance/breach of a forced marriage protection order (FMPO).

Non compliance of a FMPO can be dealt with in both the family and criminal court. If there is non compliance you have two options – 

  • You can contact the police. Breach of a FMPO is a criminal offence and the police can arrest the person the FMPO is against. This person is also known as the respondent. The court does not need to attach a power of arrest to the FMPO nor does the person protected by the FMPO or the person who applied for the FMPO if they are different need to apply to the court for an arrest warrant. Breach of a FMPO can result in a prison sentence for up to 5 years. 
  • Or if you DO NOT want to contact the police you can apply to the family court for an arrest warrant. The family court will deal with this as a contempt of court and can hand down a prison sentence for up to 2 years. You can also apply to the family court if the police and crown prosecution service decide not to take the breach of the FMPO further. You can make an application to the court for an arrest using form FL407A. You must include a signed and dated statement of truth at the bottom of your statement such as ‘I believe the above statement to be the truthful to the best of my knowledge’.

Please note the following – 

  • The respondent is the person the FMPO is against.
  • The person to be protected is the person the FMPO is protecting.
  • The applicant is the person who is completing the form(s) and submitting them to the court. This can be the person to be protected or another person.

WHAT IS THE FEE TO SEND FORM FL407A TO THE COURT AND HOW TO PAY FOR IT?

At present there is no fee to send form FL407A to the court.

HOW TO COMPLETE FORM FL407A AND WHERE TO SEND IT.

  • NOTE 1 – If you are completing and submitting form FL407A you are known as the applicant. The other party whom the application is against is known as the respondent(s).
  • NOTE 2 – You can complete form FL407A online and then print a hard copy. Alternatively you can download it, print it and then complete by black pen. 
  • NOTE  3- If you find there is not enough space to complete your answers on your form FL407A then please use additional sheets of paper to continue on and attach them to your form. Please write your name, address and question number on the top of your additional sheets of paper. 
  • NOTE 4 – Please keep a copy of your form FL407A and any attachments for yourself outside of the one you send to the family court. 
  • Form FL407A is 1 page long.
  • At the top of the page you will be asked to write the name of the court and the case number.
  • You will next be asked to write the full name of the applicant and the respondent(s) in the boxes provided.
  • Now you will be asked to write the date of the FMPO in question and details of the FMPO that the respondent should have complied with.
  • You must now write your full name as the applicant asking for the arrest warrant to be issued.
  • In the next box you will be asked to detail what in the original FMPO the respondent(s) has breached/been non-compliant. Please finish your write up with a signed and dated statement of truth such as ‘I declare the above statement to be the truth to the best of my knowledge’.
  • You must sign and date your form FL407A.
